National Assembly delegates debated the draft revised Law on Handling Administrative Violations on the afternoon of 4 November, with several asking for lighter treatment of first-time offenders, VnExpress reports. The draft is still under discussion and is not yet law.

Delegate Le Huu Tri of Khanh Hoa asked that fine bands distinguish between first-time, unintentional violations and repeat or organised ones. He also asked that the proposal to lengthen the limitation period be tied to specific fields and types of violation, so people and businesses do not face the risk of being fined years later.

Delegate Nguyen Dinh Xuan of Tay Ninh suggested that a first offence be treated as a mitigating factor, especially for technical or administrative errors, as criminal law already does. He also questioned applying fines for organisations at twice the individual rate in every case, because small household businesses differ greatly from large companies.

Delegate Nguyen Thi Yen Nhi of Vinh Long backed raising the maximum fine for individuals from VND1 billion to VND1.5 billion, and for organisations from VND2 billion to VND3.5 billion, in areas such as environmental pollution, food safety and fire prevention. She said fines must still be proportionate and enforceable.

The Assembly is still in session and the delegates' suggestions are proposals for the drafting committee, not changes to the text.
