Deputy Prime Minister Ho Quoc Dung has told agencies to clear obstacles in applying the Law on Technology Transfer while keeping the restricted and banned technology lists in Decree 101, VOV English and the government news portal report. The decree sets detailed rules for the law and took effect on 1 April 2026.
Since late April the Ministry of Science and Technology has received proposals from domestic and foreign business groups on three issues. They asked for car, motorcycle and engine manufacturing and assembly technologies to be removed from the restricted or banned lists, for an exemption for vehicles and engines made only for export, and for guidance on extending or amending contracts signed before 1 April 2026, including adding new product models.
The ministry said most concerns have been addressed. One request is still under consideration: firms want to acquire banned-list technologies for new projects begun after 1 April to make Euro 2 or Euro 3 motorcycles and cars below Euro 4 for export, because some markets still accept them.
Deputy Minister Hoang Minh said the ministry recommends keeping the lists unchanged. He warned that exceptions could encourage businesses to keep old production lines running longer, weaken domestic competitiveness, make oversight harder and let export goods enter the domestic supply chain if they cannot be sold abroad. He cited Vietnam's emissions-reduction commitments and its net-zero goal.
Mr Dung said the lists pair incentives with state management and are meant to block obsolete, polluting or inefficient technologies. He agreed that transfers of listed technologies from 1 April 2026 "must comply with its provisions".
For activity before that date, businesses may finish technology transfer contracts signed earlier, factories and production lines already using now-restricted technologies may keep operating, and companies may develop new products based on technologies they already hold. The ministry must keep monitoring implementation and answer business petitions clearly and consistently. The reports give no deadlines.
